All items are sold “as is, Where is, without guarantee of any kind”. Midnight Sun Antique Auction Company or consignors make no guarantees stated or implied to the authenticity, reliability of description, provenance or period of any item included in the auction.
Please verify our descriptions and carefully study the property at the preview or online before you bid. Condition reports are subjective and are given only as an opinion and to help guide prospective buyers and should NOT be considered as a statement of fact.
All Sales are Final! There are no returns. No Exceptions! By registering for a bidder number or when placing Absentee, Phone or Fax Bid, you agree to these Conditions of Sale.
Registration is free, but a bidder must be registered with a bidder number to bid at one of our auctions. We do require a valid Driver’s License as well as major Credit Card information
All items sold must be paid for and removed on the Sale or arrangements made. A storage fee will be charged at $25 per day after 7 days after auction for any items remaining. All purchases are to be paid for in cash, approved check, major credit card: we accept Visa /MasterCard/Discover/Amex. There will be a Buyer’s Premium of 18% added to the hammer price of successful bids. This is payable by the buyer as part of the total purchase prices. Buyers paying cash or approved check will pay 15% Buyer’s Premium.. There is no extra charge for credit card purchases. We are required by Law to collect California Sales Tax. Resale exemption with current Seller’s permit with number must be shown while registering. Bidders are solely responsible for their winning items once the Auctioneer declares them “sold”. We cannot be held responsible for lost or stolen property or for any injury. Bidders must ensure that they receive all purchases regardless if staff assists in packing items.
All items will be sold in order of Lot Number. No Lot number may be transferred to another Buyer.
Mail, Fax, Phone Absentee ( or online when applicable) bids are accepted. Phone bidding on the Sales floor can be arranged. This will be done on an outgoing basis only. We cannot be held responsible for any Absentee or Phone Bids that are not executed although the Auctioneer and Auction Staff will do everything in their power to represent these bids.
If the occasion arises, the Auctioneer may use his/her discretion and “pass” on an item if he/she feels an item has not received an adequate bid. We, as the Agent for the consignors, must also protect their interests. Consignors are not allowed to bid on their own property.
Midnight Sun Antique Auction Company reserves the right to withdraw any item at any time before the Sale or to reject a bid from any source from any bidders at any time.
Auction participants hereby indemnify and hold harmless the auctioneer, auction house and seller from any and all damages, claims or liabilities from any injuries to persons or property of any type whatsoever caused during the Sale or during removal of items purchased. Buyers removed purchased items at their own risk.
Absolutely no adjustments, claims or refunds will be allowed after Auctioneers’ report or final settlement is made with consignor. Any claims must be made while still on auction premises.
